Abstract

Teoría general de la reparación simbólica es un texto dirigido especialmente a la defensa de las víctimas de Colombia, útil para operadores jurídicos y público en general, para conocer la reparación simbólica, como mecanismo para afrontar la violación a los DDHH. Contiene un panorama sobre la incorporación y consolidación del concepto en el derecho internacional y en el derecho colombiano a partir de la justicia transicional. Se aproxima al concepto de símbolo como elemento esencial de este tipo de reparación, propone un novedoso mecanismo llamado "Test de reparación simbólica" y una serie de criterios generales y particulares, que se sugieren a la hora de ordenar reparaciones simbólicas. La reparación simbólica además de atender a las víctimas en su propio dolor, busca transformar comportamientos humanos mediante la incorporación al universo sensible de hechos, acontecimientos y graves y masivas violaciones a los DDHH que nunca deberían volver a repetirse
