Abstract

A pesar del reconocimiento universal de la presunción de inocencia como un principio fundamental del actual proceso penal y de la carga de la prueba de la responsabilidad que le asiste al Estado, como una de sus implicaciones1, están a la orden del día tanto los debates sobre la inversión de esa carga, de tal manera que sea el acusado quien deba probar su inocencia, como la consecuente afectación de ese principio.
