Los tres problemas conceptuales de la doctrina de la empresa criminal conjunta

Abstract

En este artículo se examina el razonamiento que desarrollóel Tribunal Penal Internacional para la anti­gua Yugoslavia en el caso Tadié paradarle vigencia a la doctrina de la empresa criminal conjunta a partir de lainterpretación del artículo 7 de su Estatuto. Tras identificar los argumentoscentrales y sus problemas, el autor critica el tratamiento insuficiente de losconceptos de intencionalidad, previsibilidad y cul­pabilidad en la doctrinamencionada; y propone la introducción de enmiendas al Estatuto de Roma pararectificar estas deficiencias.
