Abstract

En esta obra se propone el estudio del derecho a la propiedad colectiva de las comunidades negras de Colombia como un derecho sui géneris. La reflexión propuesta al lector se constituye en un espacio teórico de revisión de algunas figuras reconocidas en la normatividad y utilizadas por las comunidades negras como la venta, el aprovechamiento de recursos naturales, el usufructo, el arrendamiento de terrenos, la existencia de propiedad privada, la familia como eje central de la conceptualización del derecho a la propiedad, las funciones de los consejos comunitarios y el uso de mecanismos internos para la resolución de tensiones, entre otros.
