¿El Estado Constitucional en Jaque? Tomo IV. Aproximaciones críticas al fenómeno constitucional

Abstract

Con la mirada puesta en las transformaciones y desafíos del Estado constitucional en la actualidad, con un mundo globalizado que tiende a la polarización y radicalización de las ideas, un grupo de investigadores de la Universidad Externado de Colombia se ha reunido para responder, desde diferentes disciplinas y áreas, una misma pregunta: ¿Está actualmente el Estado constitucional en jaque? Es así como la obra colectiva ¿El Estado constitucional en jaque? reúne las investigaciones de más de treinta académicos colombianos que pretenden aportar a la (re) consolidación del Estado constitucional contemporáneo en su componente democrático, su relación con el derecho internacional, en el desafío que impone la superación del conflicto (la transición) y, finalmente, en la aproximación crítica al fenómeno constitucional. Este último tomo, "Aproximaciones críticas al fenómeno constitucional", apuesta por repensar la forma como se han configurado los pilares y fundamentos del Estado constitucional. Para ello, realiza un análisis crítico de algunos de los elementos diferenciadores del constitucionalismo latinoamericano, dentro de los cuales se destaca una revisión de la teoría crítica constitucional, una propuesta crítica sobre la financialización del Estado, una reivindicación sobre el binomio público-privado, reflexiones críticas en torno a la garantía de los derechos, la inclusión de la diversidad natural, cultural e ideológica y, finalmente, sobre las facultades y competencias del poder judicial.
