Artenschutzrecht – Fehlerquellen aus Theorie und Praxis

Abstract

Im grenzüberschreitenden Warenverkehr (v. a. Reiseverkehr o. Postverkehr, aber auch geregelter Tier- und Pflanzenhandel oder Übersiedlungsgut) werden häufig Exemplare von Tieren oder Pflanzen eingeführt, deren Einfuhr dem Washingtoner Artenschutzübereinkommen CITES (Convention on the International Trade in Endangered Species of Wild Fauna and Flora)2 und damit der EG-Artenschutzverordnung (EG) Nr. 338/973 (mit den Durchführungsverordnungen) und dem Bundesnaturschutzgesetz (BNatSchG) entgegenstehen könnte. Der Verfasser dieses Beitrags hatte Gelegenheit, am einwöchigen Artenschutzgrundlehrgang des BWZ zum Artenschutz teilzunehmen. Erneut wurde deutlich, dass es sehr viele (unerwartete) Fallstricke in der praktischen Anwendung des Artenschutzrechts gibt – dieser Beitrag versucht auf Probleme hinzuweisen, diese zu thematisieren und dabei in Theorie und Praxis zu minimieren.
