Abstract

Der Artikel entfaltet die Potenziale der Luhmannschen Verfahrenssoziologie für eine gesellschaftstheoretisch informierte Organisationsforschung. Er leistet damit zugleich einen Beitrag zur Erweiterung der Typen sozialer Systembildung. Meine Ausgangsbeobachtung ist, dass die Legitimation von Verfahrensentscheidungen eine Legitimation der übergreifenden Verfahrensstrukturen voraussetzt. Aufbauend auf dieser These wird gezeigt, dass es Organisationen sind, die nicht nur für gesellschaftliche Funktionskontexte, sondern auch für Verfahrenssysteme rechtlich abgesicherte Entscheidungsprämissen spezifizieren. Am Material einer historisch-soziologischen Fallstudie zur Organisationsgenese eines Höchstgerichts veranschauliche ich exemplarisch, wie Verfahren durch formale Organisation mitstrukturiert werden und welche informalen Folgeprobleme mit einer organisationalen Verschachtelung von Verfahren verbunden sind.
