The Un Human Rights Council'S Universal Periodic Review As A Rhetorical Battlefield Of Nations

Abstract

Applying the case study of Saudi Arabia, this article examines the rhetoric of nations who are well documented as being severe violators of human rights and the use they make of the UN Human Rights Council Universal Periodic Review (UPR) mechanism to defend, downplay, and deny their human rights violations. Authoritarian countries who violate human rights systemically, severely, and intentionally as a matter of government policy apply different rhetorical strategies when undergoing the UPR process and writing and submitting their respective national reports for the UPR process. This article analyzes these strategies, illustrates how different countries use them during the UPR process, and explores the value and limitations of the UPR process and its efficacy at advancing human rights. Aplicando el estudio de caso de Arabia Saudita, este artículo examina la retórica de naciones que están bien documentadas como violadoras graves de los derechos humanos y el uso que hacen del mecanismo de Revisión Periódica Universal (UPR) del Consejo de Derechos Humanos de la ONU para defender, minimizar y niegan sus violaciones a los derechos humanos. Los países autoritarios que violan los derechos humanos de manera sistemática, severa e intencional como una cuestión de política gubernamental aplican diferentes estrategias retóricas cuando se someten al proceso EPU y redactan y presentan sus respectivos informes nacionales para el proceso EPU. Este artículo analiza estas estrategias, ilustra cómo los diferentes países las utilizan durante el proceso del EPU y explora el valor y las limitaciones del proceso del EPU y su eficacia para promover los derechos humanos. 本文以沙特阿拉伯作为案例研究,分析了那些被充分记录为严重侵犯人权的国家的修辞言论,以及其为捍卫、淡化和否认其人权侵犯而对联合国人权理事会普遍定期审议 (UPR)机制的使用。那些将人权作为一项政府政策而系统性、严重和故意侵犯人权的威权主义国家,在进行UPR过程以及为UPR过程编写和提交各自的国家报告时采用不同的修辞策略。本文分析了这些策略,阐明了不同国家在UPR过程中如何使用策略,并探究了UPR过程的价值和局限性及其在促进人权方面的效能。
