Осуществление Контроля (Надзора) Государственными И Муниципальными Учреждениями: Проблемы И Пути Их Решения

Abstract

В соответствии с общим правилом, установленным законодательством о государственном контроле и антимонопольным законодательством, осуществление контрольно-надзорных полномочий государственными и муниципальными учреждениями недопустимо. Однако, несмотря на установленный запрет, федеральное законодательство и законы субъектов РФ предусматривают возможность осуществления отдельных видов контроля (надзора) этими учреждениями. в ряде случаев они наделяются контрольными полномочиями разного уровня ведомственными актами. Исследование выявило 6 видов контроля, осуществляемого федеральными учреждениями, 5 видов контроля (надзора), реализуемого учреждениями субъектов РФ, и 4 вида контроля, осуществляемого муниципальными учреждениями. Встатье рассматриваются минусы осуществления контроля государственными и муниципальными учреждениями, а также анализируются различные варианты решения указанной проблемы.
