Институциональные Основы Интеллектуальной Собственности: Достоинства И Недостатки

Abstract

Предметом рассмотрения данной статьи является интеллектуальная собственность через призму институционально-экономического направления. Представлена общая характеристика института интеллектуальной собственности, раскрываются его основные функции, а также мировая практика разнообразия режимов интеллектуальной собственности. Затрагиваются вопросы основных достоинств и ряда недостатков патентных систем. В качестве коррекции негативных эффектов института интеллектуальной собственности предлагается использование таких механизмов, как принудительное лицензирование, выкуп патента, ценовая дискриминация и перекрестное лицензирование.
