Abstract

Статья посвящена изучению зарубежного опыта реализации различных видов профессионального судебного представительства, в первую очередь применительно к административному судопроизводству. Автор рассматривает вопросы, связанные с ограничением правовой возможности для представительства в суде без наличия статуса адвоката (профессиональное судебное представительство в виде полной или частичной адвокатской монополии), а также специальными требованиями к образованию и опыту юридической практики как для лиц, оказывающих юридическую помощь, так и для субъектов, самостоятельно представляющих свои интересы в суде без привлечения представителей. Современное правовое регулирование за рубежом идет по более«жесткому» пути внедрения в судопроизводство (в том числе административному) различных институтов профессионального судебного представительства, вплоть до полной адвокатской монополии.
