Особенности Проведения Ретроспективной Оценки В Рамках Судебной Экспертизы В Сфере Залогового Кредитования

Abstract

В статье исследуются коллизии законодательства об оценочной деятельности, связанные с понятием «залоговой стоимости» имущества. Анализируются риски (залоговый дисконт), которые принимает на себя банк, беря в залог имущество, в условиях стабильного (растущего) рынков, и в условиях кризиса. Отмечается, что именно в условиях кризиса возможны ситуации, требующие разрешения в судебном порядке с использованием результатов судебной экспертизы в рамках «ретроспективной» оценки. Предложены некоторые меры по устранению разночтений как смыслового, так и методического характера применительно к «залоговой стоимости» имущества.
