Abstract

Рассматриваются проблемы использования категории добросовестности при защите права участия в обществе с ограниченной ответственностью (ООО). Обосновывается тезис о том, что в доктрине и судебной практике необходимо разработать специальные критерии определения добросовестности приобретателя доли в ООО.The study explores the principle of good faith in protecting the rights of purchase of a participatory interest in the charter capital of a limited liability company (LLC). the author believes that in doctrine and court practice it is necessary to develop specific criteria for determining the principle of good faith of the purchaser of a share in an LLC.
