Abstract

Комплекс явлений, который сегодня принято называть глобализаций товарных и финансовых рынков, сводится не только к формированию трансграничных потоков капитала и товаров в качестве определяющего фактора конъюнктуры мировых и национальных рынков, но также включает в себя явление, в известной степени препятствующее такому развитию событий. Речь идет об ограничении конкуренции на внутренних рынках определенного государства, которое является следствием действий иностранных лиц или организаций, совершаемых ими за пределами его юрисдикционной территории (далее внутреннее ограничение конкуренции иностранными хозяйствующими субъектами). Статья содержит анализ российского законодательства и практики иных юрисдикций и представляет несомненный практический интерес для руководителей и топ-менеджеров компаний, для специалистов в области ВЭД, для предпринимателей-практиков, но будет интересна и широкой аудитории.
