Границы рынка и особенности конкуренции на рынках услуг Visa и MasterCard: уроки применения антимонопольного законодательства

Abstract

В современной экономической и юридической литературе до сих пор не был представлен единый подход к определению рынков, подобных рынку платежных систем (рынков с двухсторонними сетевыми эффектами). Нет согласия и в ответе на базовый вопрос как должны определяться границы такого рынка. В статье рассмотрены особенности рынков с двухсторонними сетевыми эффектами, представлен обзор дел зарубежных антимонопольных органов против платежных систем, а также дана характеристика определения рынка в таких делах.Проведенный анализ позволил сделать вывод о способе применения в антимонопольной политике универсальных правил, аналогичных тем, которые зафиксированы в Порядке проведения анализа состояния конкуренции на товарном рынке, утвержденном приказм ФАС России от 28.04.2010 № 220. На рынках с особой структурой экономический анализ может выходить далеко за рамки предусмотренной данным Порядком строгой последовательности и требовать применения более широкого набора инструментов.
