Предупреждение Преступлений В Сфере Предпринимательства

Abstract

В российской юридической практике существуют различные подходы к содержанию определения незаконного предпринимательства как правового явления, а также имеется неопределенность в решении вопроса о правильном применении законодательства об ответственности за преступления в сфере экономической деятельности. Автор предлагает рассмотреть понятие предпринимательства (предпринимательской деятельности) методом «определения от противного», поскольку уголовным законодательством Российской Федерации дана дефиниция «незаконного предпринимательства».
