Проблемы Применения Меры Пресечения В Виде Домашнего Ареста

Abstract

Проблемы применения домашнего ареста сгруппированы автором в зависимости от структуры положений ст. 107 Уголовно-процессуального кодекса России. В первую группу отнесены определение места нахождения обвиняемого (подозреваемого) под домашним арестом и объема возлагаемых правоограничений. Во вторую – установление срока домашнего ареста и последующего его продления, либо изменение меры пресечения. В третью – определение круга лиц, к которым применение домашнего ареста будет оптимальной мерой пресечения. По результатам исследования внесены предложения об изменении действующей редакции ст. 107 Уголовно-процессуального кодекса России
