Общественный Контроль На Муниципальном Уровне: Анализ Новелл Законодательства

Abstract

На основе проведенного анализа новелл отечественного законодательства в сфере общественного контроля, в частности, Федерального закона № 212-ФЗ «Об основах общественного контроля в Российской Федерации» от 21.07.2014, авторами делается вывод о создании в России системы общественного контроля на федеральном, региональном и муниципальном уровнях на основе деятельности таких институтов гражданского общества, как Общественная палата РФ, общественные палаты субъектов РФ и общественные палаты (советы) муниципальных образований. Однако в ходе исследования выявлен существенный пробел действующего законодательства в части создания муниципального общественного контроля в связи с отсутствием субъектов контроля – общественных палат (советов) муниципальных образований, создание которых не является обязательным. На основе проведенного исследования авторами формулируется предложение о внесении изменений в законодательство в части повышения эффективности общественного контроля.
