Провоцирующее Поведение Потерпевшего И Его Отличие От Провокации Преступления

Abstract

Цель: определить основные элементы провоцирующего поведения потерпевшего и его отличие от провокации преступления. Методы: диалектический подход к изучению социальных явлений, а также использование исторического и сравнительно-правового методов в исследовании правовой реальности. Результаты: научное обоснование теоретико-правовых основ института провокации и формулирование на этой основе предложений по совершенствованию его законодательного регулирования и повышению эффективности правоприменения. Научная новизна: в статье предложена авторская классификация видов и форм провокационной деятельности в нормах как Общей, так и Особенной части. Практическая значимость: определяется обобщением и анализом современного эмпирического материала о практике применения норм, содержащих признаки провокации, разработкой на основе собственных научных исследований соответствующих рекомендаций организационного и методического характера.
