Актуальные Вопросы Противодействия Коррупционным Преступлениям

Abstract

Цель: найти ответы на актуальные вопросы противодействия коррупционным преступлениям. Методы: методологическую основу исследования составили всеобщий диалектический метод познания, а также основанные на нем общенаучные, специальные и частноправовые методы исследования. Результаты: на основе анализа и обобщения результатов следственно-судебной практики, положений законодательства и доктрины уголовного права показаны особенности а) определения предмета и выявления субъективных признаков взяточничества; б) установления факта вымогательства взятки, обещания/предложения посредничества во взяточничестве. Научная новизна: найдены ответы на актуальные вопросы противодействия коррупционным преступлениям. Практическая значимость: результаты проведенного исследования возможно использовать в научной, законотворческой и правоприменительной деятельности, в учебном процессе юридических вузов и факультетов.
