О Соотношении Категорий «Предприятие» И «Единый Недвижимый Комплекс»

Abstract

Цель: анализ и сравнение правовых категорий «предприятие» и «единый недвижимый комплекс» как «комплексных» объектов гражданских прав в сравнительном аспекте. Методы: в работе применялись формально-логический и сравнительный методы исследования. Результаты: Выявлены общие и отличительные характеристики предприятия и единого недвижимого комплекса. Дано авторское определение правовой категории «предприятие». Сделан вывод, что распространение правового режима недвижимости на данные комплексные объекты является упрощением их гражданского оборота. Научная новизна: Автором выделены критерии разграничения категорий предприятие и единый недвижимый комплекс. Практическая значимость: Результаты научного исследования можно использовать в правотворческой и практической деятельности, равно как и для научных разработок в области гражданского права.
