Действие Последствий Судимости Во Времени И Их Классификация

Abstract

Цель: доказать, что в ряде случаев последствия судимости не прекращаются ее погашением или снятием, предложить их классификацию, а также внести предложение в действующее уголовное законодательство. Методы: всеобщий диалектический метод познания; общенаучные, специальные и частноправовые. Результаты: доказано, что действие последствий судимости не всегда ограничивается погашением или снятием судимости, и в зависимости от их действия во времени они могут быть классифицированы на срочные, неопределенно срочные и бессрочные (пожизненные). В целях устранения противоречий с законодательной формулировкой о срочности последствий судимости вносится предложение о внесении изменений в ст. 86 УК РФ. Научная новизна: впервые в теории российского уголовного права предложена классификация действий последствий судимости во времени. Практическая значимость: результаты исследования, углубляющие представление о правовой природе судимости, могут быть использованы при совершенствовании уголовного законодательства, в учебном процессе.
