Дифференцирование Применения Принципов Гражданского Права В Судебной Практике

Abstract

Цель: исследование механизма реализации принципов российского гражданского права в судебной практике. Для ее достижения раскрываются основные варианты применения основных начал гражданского законодательства, критикуется закрепленная в Гражданском кодексе РФ модель «аналогии права». Методы: сравнительный, функциональный, формально-логический, документальный. Результаты: автор приходит к выводу о вариативности применения судами основных начал гражданского законодательства. Научная новизна: в авторской классификации принципов гражданского законодательства, в рамках которой особо выделены конституционные принципы гражданского права (суды всегда ссылаются на них в своих решениях) и все остальные принципы, указанные в ст. 1 ГК РФ (суд обращается к ним в том случае, если отсутствует специальная норма, регулирующая спорное отношение). Практическая значимость: вывод о том, что отсутствие специальной нормы позволяет судам либо применять аналогию закона, либо принять решение в соответствии с основными началами гражданского законодательства.
