О Сущности Юридической Конструкции Гражданского Права И Ее Отраслевой Специфике

Abstract

Цель: выявить сущность юридической конструкции в гражданском праве. Методы: общеметодологическую основу составил общенаучный (диалектический) метод познания правовой действительности, позволивший рассмотреть проблематику юридических конструкций гражданско-правовой отрасли. В ходе исследования применялись такие частнонаучные методы познания, как формально-юридический, сравнительно-правовой, логический. Результаты: путем анализа отраслевых особенностей юридической конструкции выявлена ее сущность в гражданском праве. На примере юридической конструкции договора раскрыты единство и дифференциация юридической конструкции гражданского права и конструкции иной отраслевой принадлежности. Научная новизна: дано авторское определение юридической конструкции гражданского права, выявлены ее отраслевые признаки. Практическая значимость: сформулированные в статье теоретические положения могут быть использованы в работе правотворческих органов при совершенствовании норм действующего законодательства; для проведения экспертиз нормативных правовых актов с целью выявления коллизий; в учебном процессе в рамках преподавания курсов «Гражданское право».
