К Вопросу О Юридической Конструкции Консенсуального И Реального Договора

Abstract

Цель: выявить сущность консенсуального и реального договоров как юридических конструкций. Методы: историко-правовой, формально-юридический и сравнительно-правовой. Результаты: используя методологические свойства категории «юридическая конструкция», автор сравнил реальную и консенсуальную сделки, проанализировал правовую природу действия по передаче имущества и его значение для гражданского договора. Научная новизна: выявлено и обосновано проявление принципа единства и дифференциации во взаимодействии договора-юридического факта и договорного правоотношения как элементов юридической конструкции гражданско-правового договора. Практическая значимость: заключается в возможности использовать результаты исследования в правоприменительной деятельности и в договорной практике.
