Abstract

Цель: сформулировать авторское определение понятия «участники юридической аргументации» и рассмотреть их состав. Методы: Методологическую основу исследования составили всеобщий диалектический метод познания, а также основанные на нем логический, системный, сравнительный и иные методы научного поиска. Результаты: На основе проведенного анализа состава участников юридической аргументации обосновано мнение о разграничении понятий «участник юридической аргументации» и «субъект юридической аргументации», рассмотрении субъекта в качестве одного из участников юридической аргументации наряду с адресатом и иными участниками. Научная новизна: Впервые в юридической науке рассмотрен состав участников юридической аргументации, выявлены и проанализированы специфические черты, характеризующие субъект, адресат и иных лиц в юридической аргументации. Практическая значимость: Сформулированные в исследовании теоретические положения могут быть использованы в научной, законотворческой и правоприменительной деятельности, учебном процессе учреждений высшего профессионального образования юридического профиля.
