«Использование Служебного Положения» Как Способ Совершения Преступлений: Вопрос Судебного Толкования

Abstract

В статье исследуется один из наиболее спорных и актуальных в теории и практике уголовного права признаков служебных преступлений «использование служебного положения». Анализируются его толкования по девяти постановлениям Пленума Верховного Суда РФ; приводится классификация этих интерпретаций. Предлагаются варианты преодоления рассогласований официальной трактовки соответствующей категории, обосновывается положение о целесообразности ее однозначного толкования.
