Теоретико-Исторический Анализ Становления Института Суда Присяжных В России

Abstract

С момента признания необходимости восстановления судопроизводства с участием присяжных Концепцией судебной реформы в РСФСР (1991 г.) и до настоящего времени в обществе, в среде теоретиков и практиков нет однозначного отношения к данному институту. Современные проблемы создания и функционирования суда присяжных, его критика в значительной своей части совпадают с имевшими место в XIX начале XX вв. В настоящей статье автором предпринята попытка кратко проанализировать основные этапы становления института присяжных заседателей в России. В результате исследования сделан ряд выводов доктринального и практического характера.
