Abstract

В статье рассматривается проблема нарушения права лица на справедливое судебное разбирательство при рассмотрении уголовных дел, основанных на результатах проверочной закупки наркотических средств, с позиции практики Европейского Суда по правам человека. Предлагаются рекомендации по организации, проведению и документированию проверочной закупки наркотиков, позволяющие сформировать систему доказательств, соответствующую требованиям Европейского Суда.
