О Понятии Гражданско-Правового Режима Самовольной Постройки

Abstract

Строительство новых объектов недвижимости, реконструкция уже построенных жилых домов, зданий и иных сооружений порождает проблему, связанную с легализацией самовольно возведенных объектов недвижимости. В этой связи настоящая статья посвящается исследованию гражданско-правовой природы режима самовольной постройки. Исследование указанной проблематики происходит на основе выработки авторского представления о категории «самовольная постройка». По ходу анализа понятия «режим», «правовой режим», «правовой режим объектов гражданских прав» формируется понятие гражданско-правового режима самовольной постройки, а также дается дефиниция механизма нормативного закрепления гражданско-правового режима самовольной постройки и раскрывается его правовая природа.
