Анализ Некоторых Правовых Коллизий В Процессе Применения Норм О Несостоятельности (Банкротстве)

Abstract

Реализация норм Закона о банкротстве выдвигает на передний план необходимость единообразного и эффективного его применения арбитражными судами и исполнительными органами государственной власти. В тоже время на практике из-за различного толкования норм Закона о банкротстве органы государственной власти находятся в состоянии непонимания между собой. Для повышения эффективности применения нормативных правовых актов в данной сфере необходимо активное участие правоприменительных органов в обсуждении проектов изменений и дополнений в нормативные правовые акты, создание межведомственных комиссий для проведения мониторинга законопроектов, моделирование путей реализации разрабатываемых «новых» норм права, поиск наиболее оптимальных решений для их внедрения в уже существующую действующую правовую систему.
