Abstract

На основе изучения широкого круга работ специалистов в области уголовного права и критического анализа норм уголовного закона предложено изменить законодательную трактовку кредита как предмета преступления ст. 176 УК РФ, исключив при этом льготные условия кредитования из числа предметов данного преступления. Кроме того, обосновано предложение рассматривать государственный целевой кредит не как предмет состава ч. 2 ст. 176, а как предмет состава ст. 285.1 УК РФ.
