Совершенствование Российского Нормативноправового Регулирования Франчайзинга В Сфере Услуг С Учетом Зарубежного Опыта

Abstract

Недостаточное использование франчайзинга является одним из главных факторов, затрудняющих развитие сферы услуг России. Основные проблемы франчайзинга в России в настоящее время концентрируются в законодательно-правовой области. В отечественной системе права не существует специального закона о франчайзинге. Россия существенно отстаёт от США и Европы в части относящихся к франчайзингу и действующих законов и практики. Необходимо оперативное проведение корректировки действующего в России законодательства, в первую очередь, приведение его в соответствие с принятыми на Западе стандартами франчайзинга, в особенности относящимися к защите франчайзеров и франчази.
