Особенности Криминалистического Обеспечения Расследования Незаконной Добычи (Вылова) Водных Биологических Ресурсов

Abstract

В статье рассматриваются криминалистическая характеристика и типичные следственные ситуации на первоначальном этапе расследования данного вида преступлений, вопросы выдвижения и проверки следственных версий. Опираясь на научные позиции криминалистики и, исходя из анализа практической деятельности по расследованию незаконной добычи (вылова) водных биологических ресурсов, выделяются характерные элементы криминалистической характеристики рассматриваемого преступления, и пять основных видов типичных следственных ситуаций, обладающих определенной спецификой, которые могут сложиться на первоначальном этапе дознания. На основе анализа научных достижений криминалистики обосновывается употребление понятия «типичная следственная ситуация» и предлагается её авторское определение
