Правовые Формы Проявления Иностранного Элемента В Наследственном Отношении

Abstract

В данной статье исследуется категория иностранный элемент, а также гражданско-правовые отношения с иностранным элементом. Актуальность данной темы связано с увеличением наследственных дел, осложненных иностранным элементом. Автор проводит теоретический анализ наследственного отношения, а также правовые формы проявления иностранного элемента в наследственном отношении: субъект, объект и юридический факт. Квалификация наследственного отношения как осложненного иностранным элементом в коллизионном регулировании имеет важное правовое значение. На основании квалификации наследственного отношения определяется применимый правопорядок.
