Abstract

Цель исследования: комплексное изучение трудоправового аспекта в сфере регулирования надбавок и доплат стимулирующего характера. Задачи: разграничение и выявление особенностей надбавок и доплат стимулирующего характера, разработка собственник дефиниций терминов. Методы: Комплексность предмета исследования обусловила необходимость использования как общенаучных методов (анализ, синтез, аналогия, обобщение), так и специальных - юридических (юридико-технический и догматический). Итоги: предложены основания для разграничения надбавок и доплат стимулирующего характера; при отсутствии законодательного регулирования данные выплаты являются взаимозаменяемыми в теории и на практике, хотя на самом деле должны устанавливаться работодателем с чётким пониманием правовой природы каждой выплаты в отдельности
