Трансформация Правовой Культуры Таджиков И Развитие Её Содержательных Компонентов В Рамках Исламской Цивилизации

Abstract

В данной статье автором исследуется вопрос трансформации правовой культуры таджиков, а также ее содержательных компонентов в рамках исламской цивилизации. Следует отметить, что на территории исторического Таджикистана в период существования исламской цивилизации правили такие влиятельные династии как Тахириды, Саффариды, Саманиды и др. Автор обращает внимание на влияние политики этих династий и методов их правления на совершенствование правовой культуры населения. Выясняется, что в целом правовая культура таджиков в период арабского завоевания во многом претерпела трансформацию под натиском и влиянием исламских ценностей. Однако сохранившиеся духовно-культурные компоненты зороастрийской правовой культуры все же обеспечивали преемственность прежнего права.
