Abstract

В статье представлена авторская позиция по вопросу философских оснований теории права, в которых различаются рефлективные и валюативные философские основания. С этих позиций рассмотрена тема социальной справедливости в праве, применительно к которой общая трактовка справедливости в рамках нормативного подхода в праве может быть отнесена к валюативной, а частная трактовка справедливости в дескриптивном подходе − к рефлективной философии.
