Abstract

Изменения гражданского законодательства должны основываться на теоретических разработках и предложениях ученых. Несмотря на вскрытые проблемы в делении юридических лиц на коммерческие и некоммерческие организации, они не нашли своего решения в проекте изменений Гражданского кодекса Российской Федерации. Отсутствие адекватного реагирования со стороны законодателя к решению вопросов развития системы юридических лиц может привести к дальнейшему усугублению противоречий между «цивилистическим» подходом к определению соотношений объема понятий «юридическое лицо» и «организация» и теми разработками, которые ведутся в настоящее время в науке предпринимательского права. Достижение согласия и нахождение общих точек соприкосновения между данными научно-практическими подходами оказали бы благоприятное влияние на развитие как законодательства в России о юридических лицах, так и правоприменительной практики
