Безналичные Денежные Средства Как Объект Кредитного Договора

Abstract

Объектом кредитного договора являются денежные средства, согласно Гражданского кодекса РФ. При этом в силу необходимости обеспечения безопасности получения денежных средств заемщиком, а также оптимизации ресурсов банка, все чаще кредиты выдаются путем зачисления суммы кредита на банковский счет заемщика. В связи с этим возникает вопрос о существовании безналичных денежных средств как самостоятельного объекта гражданских прав. Автор анализирует существующие в юридической литературе позиции по вышеуказанным вопросам с учетом последних изменений Гражданского кодекса РФ в данной части. В статье даны рекомендации по совершенствованию гражданского законодательства РФ в целях устранения имеемых противоречий.
