Классификация Законов В Концепции Систематизации Российского Законодательства М. М. Сперанского

Abstract

В данной статье рассматриваются теоретические основания классификации законов М.М. Сперанским, созданной им в рамках подготовки Свода законов Российской империи. Рассматриваются предложенные Сперанским виды систематизации законодательства, цели и задачи систематизации. Анализируется разделения Сперанским законов на государственные и гражданские, описываются виды гражданских и государственных законов. Прослеживается влияние теории классификации законов на структуру Свода законов; проводится анализ структуры Свода законов с учетом поставленных М.М. Сперанским целей работы по систематизации российского законодательства.
