Abstract

Деятельность органов контроля и надзора не отвечает современным требованиям вследствие несовершенства законодательной базы. Правовая регламентация отношений, складывающихся в процессе осуществления контроля и надзора, имеет многочисленные недостатки. В частности, не всегда прописана функциональная принадлежность и компетенция должностных лиц контрольных и надзорных органов, на законодательном уровне не определены меры их правовой защиты в контрольном процессе, а также критерии ответственности за допущенные нарушения.
