Abstract

В статье рассматриваются актуальные вопросы использования защитником, участвующим в собирании доказательств, новых источников доказательств заключения специалиста и показаний специалиста. Проанализированы различные точки зрения ученых-процессуалистов относительно указанных возможностей защитника, изучена правоприменительная практика по данной теме, предложены возможные пути совершенствования и расширения возможностей использования защитником, в процессе его участия в собирании доказательств, заключения специалиста и показаний специалиста.
