Abstract

Термин «новые обстоятельства» в Уголовно-процессуальный кодекс Российской Федерации был введен впервые. На сегодняшний день в юридической литературе нет единого мнения по этому вопросу. Но судебная практика показала, что данный институт позволяет исправить допущенную судом ошибку по вступившему в законную силу приговора суда, а в некоторых случаях по исполненному приговору; восстановить нарушенные права и законные интересы граждан; установить истину по делу и решить вопрос о наказании виновных или реабилитации невиновных.
