Форма Правления Как Особый Вид Правоотношения

Abstract

В научных кругах ведется дискуссия относительно определения такого важного института теории государства и права как форма правления. Подавляющее большинство из предлагаемых дефиниций центральное внимание уделяют при рассмотрении этой категории какому-либо одному из ключевых признаков, характеризующих форму правления (количеству высших должностных лиц, порядок формирования высших органов власти и др.). Подвергнув критическому осмыслению существующие определения формы правления, автор предлагает собственное понимание категории «форма правления» как правоотношения со своим объектом, субъектами и содержанием.
