Обязательства Российской Федерации Из Участия В Заемных Отношениях (На Примере Государственного Займа)

Abstract

Отношения государственного займа традиционно в советский период относили к сфере публичного права. В постсоветский период также высказывалась точка зрения, что данные отношения следует отнести к сфере финансового права. Корректировка роли государства в экономических отношениях, произошедшая в период крупномасштабных реформ, повлекла принципиально новое понимание сущности государственного займа, акцентирующее внимание на его договорном характере, что нашло отражение в гражданском законодательстве. Вместе с тем договорные отношения, связанные с государственным займом, относятся к числу тех, где наряду с гражданско-правовой регуляцией начинает отчетливо проявлять себя регуляция публично-правового характера (в частности, бюджетное регулирование). В связи с этим можно говорить о двойственной правовой природе данных отношений (регулируемых нормами как гражданского, так и специального законодательства).
