Исключения В Праве: Сущность И Юридическая Природа

Abstract

В статье анализируется сущность такого явления как исключения из общих правил в сфере правового регулирования. Автор подчеркивает, что наличие исключений объясняется прежде всего необходимостью более эффективного регулирования общественных отношений. Используя только единые правила объективно невозможно учитывать многообразные жизненные ситуации, исключительные случаи, особые обстоятельства. Вместе с тем исключения не должны подрывать правила, вести к их нарушению. Следовательно, изучение юридической природы исключений в праве важное и перспективное направление научного исследования.
