Профессиональная Тайна Адвоката Как Одно Из Основных Требований Адвокатской Этики

Abstract

В предлагаемой статье автор постарался проанализировать одну из самых сложных этических проблем, возникающих при осуществлении адвокатской деятельности. Основной акцент автор сводит к вопросу о возможности разглашения сведений переданных адвокату его доверителем, о готовящемся тяжком и особо тяжком преступлении. Так же автор уделяет особое внимание вопросу о доверительных началах адвокатской деятельности. Тема предлагаемого автором исследования достаточно актуальна, поскольку в Конституции РФ закреплено право каждого гражданина на квалифицированную юридическую помощь. В свою очередь обеспечение данного права невозможно без сохранения конфиденциальности отношений между адвокатом и его доверителем. Адвокатская тайна всегда была и остается острой этической проблемой, рассмотрение которой очень важно для всего института адвокатуры
