Модификация Относящихся К Недвижимости Норм Раннего Общего Права Под Влиянием Права Справедливости В Англии

Abstract

В статье исследуются причины модификации относящихся к недвижимости норм раннего общего права (common law), приведшие к возникновению доверительной собственности в средневековой Англии; анализируется положение владельца недвижимости (tenant of land) согласно нормам действовавшего в английском обществе в начале XIII века общего права, рассмотрены основные ограничения и обременения прав владельца недвижимости.
