Abstract

Статья Щербининой И.В. «Спорные вопросы уголовно-правовой квалификации случаев отравления учащихся и воспитанников образовательных учреждений» посвящена сложным вопросам квалификации нарушений санитарно-эпидемиологических правил, повлекших отравление учащихся и воспитанников образовательных учреждений. В своей статье автор предлагает квалифицировать причинение вреда учащемуся в результате неправильно организованного питания по ст. 143 УК РФ, а не по ст. 236 УК РФ. По мнению автора, в противном случае речь идет о необоснованной декриминализации единичных (не массовых) случаев отравления учащихся, что не соответствует принципу повышенной опасности преступлений, направленных против несовершеннолетних по сравнению с причинением вреда взрослым потерпевшим.
